I don't really understand what's the point here. Both new-style BSD and 
MIT licenses allow you to distribute the code as part of a GPLed 
package. This is not relicensing, as the original license of 
prototype.js is untouched unless you deliberately change it. If we ship 
the upstream version, it will stay licensed as it is now, which is not 
at all a problem for us.

IMHO this is not worth even asking ifross or any other legal advisors.

PS: I agree that we should open up TER for GPL-compatible licenses, so 
that people who'd rather use BSD or LGPL or whatever are not discouraged 
to use TER.
