[Typo3] Is typo3 3.8.0 beta2 + Templavoila 4.0 bad?

My mistake. I thought I had fixed this once last week and was playing 
around with another test install today, and thought that corrected it.

it didn't. I am also getting this error

Warning: mysql_fetch_assoc(): supplied argument is not a valid MySQL 
result resource in
/typo3_src-3.8.0rc1/t3lib/class.t3lib_db.php on line 740

in addition to the broken tree root message.

Here is the line from t3lib_db.php
739	function sql_fetch_assoc($res)	{
740		return mysql_fetch_assoc($res);

I'm tired and clueless. Any ideas
