Thank you all for your input. My "solution" was at the end: 
$TYPO3_CONF_VARS['FE']['pageNotFound_handling'] = 'http://' . 
$_SERVER['SERVER_NAME'] . '/404/'; I dont know if its the perfect 
solution, but it stopped the php-warnings in my log-file.
