But right now we are in some kind of "broken" state.

Either typo3 doesn't really support HTML 4.01 anymore (all the slashes)
so the possibilty to select some 4.x doctype must be prohibited.

or the slashed are just wrong and there would be a kind of '.($this->xhtml?'/':'').'>' needed for every slash
