Hi,

testing unveiled some further issues (see #0013928) in this area. But 
that's another task ;)

Regarding your patch - I don't really like that you depend everything on 
"$canCreateNew" ... we should imho distinguish between "$canCreateNew" 
and "$canEditContent".

The attached v2 reflects that - I also moved the relevant parts into 
it's own method.
