That's what I thought. User Settings is also using that logic.

So attached is a v3 that will check for the file and the contents of the 
file, and if no KEEP_FILE is inside, then it will delete it. Taken from 
class.t3lib_befunc.php line 4203 and adjusted for this need.

Also corrects the label. One core dev could test and commit, please ;)

And yes, it should all be centralized at some point, but for now let's 
just get this in. The re-factoring should be done in a separate RFC anyways.
