Might be, you never know if some rights in the typo3conf folder was 
changed by some strange situation (or person ;)). Anyways, the check 
should be better both ways imho.

And yes, heard someone some time back saying a new method was under way 
for this task, but until that happens, I guess it won't hurt to improve 
the current code with 2 minute simple no-brainers.
