it's because realurl does not set the flag in his faked TSFE. Normaly only index_ts.php sets this flag.

i tried to set it to "1" in the faked TSFE from the realurl hook, but i got a bunch of other errors then.

This is why i think it's mainly a realurl issue, but it can be fixed in the core easily and in a senseful way (like the
patch does). I can't imagine that it would break anything, but it will make whichWorkspace much mor stable.
