Yeah, your right. The bug does *not* occur if forceCharset is utf-8
The Ajax-Request is always encoded in UTF-8 and thus the error only
ouccurs if the backend is *not* in utf-8 e.g. iso-8859 (which is default)

not-utf8-installation and increase your vote by 1 :-)
