As I read the xml standard you may omit the prologue only if the 
document is in the default encoding which is utf-8. And note also that 
xhtml is for interoperability reasons never served with a proper MIME 
type, but as text/html. Which is a nuisance for all standard loving gusy 
and lasses :-)
