Benni's patch contains those lines:
--- typo3/mod/tools/em/class.em_index.php	(revision 2615)
+++ typo3/mod/tools/em/class.em_index.php	(working copy)

which usually means that you can just use the "update to revision" 
feature of SVN to checkout revision 2615, then apply the patch (which 
should apply just fine) and then update your source to latest trunk again.
