[TYPO3-mvc] Query: problem searching in a not linked sub object

i've been struggling debugging a complex query on linked objects (if you 
search in a linked object and that is not there.. the query fails!!! 
what a terrible base error in Extbase)

i found the problem .. that somebody had already found proposing a patch:

but that patch doesn't work well (at least with TYPO3 4.7)

i added the missing lines

i can't manage to submit it to Gerrit (i tried several times.. but it' 
too much for me)

i hope that someone can go on with that

(or i'll start forking the Core for my projects ;)
