Maybe it could be include as option?
So insert the isset($_REQUEST["recs"]["personinfo"]["agb"]
in the $this->checkRequired() function and make it there as an option.

All user using the agb's in the moment could set easily an param with 
the object browser or maybe it could be aksed while installing.
