[TYPO3-linux] typo3 can't write to localconf.php

I have just moved some websites to another server, with fresh install.
I have some experience so i didn't have much problem's except one

The webserver can't write to php files.
I can make other files I can write to files, just not php files.
So I am thinking there is a setting or maybe even a module in php or 
even apache that prevents writing to php files.


I have tried all the options of owner and rights.

configuration:
Centos
apache 2.2
php 5.2.17
mod_ruid2

btw I have tried several disable_functions options.
Currently it's -
disable_functions=show_source, system, passthru, popen, proc_open, copy


Does anyone have any suggestions for me
