[TYPO3] XML declaration in header

I had exactly the same problem.
what is useful, (if you know php), is to look at the class
'class.tslib_pagegen.php'
this is where alot of the typoscript is parsed into the html markup.
this has been alot more helpful than using typoscript ref, by far
but, dont change it!!!!

You can disable that.
Put this in your TS Setup:
config.xmlprologue = none
