[TYPO3] Horizontal Rule

hi,

when inserting horizontal rule using the RTE, at first insist it inserts the
horizontal rule, and preserves it, when you makes changes to the page again,
it automatically removes the horizontal rule, when saved.

code also looks weird after first save:
<p><h1><p></p>

would really appreciate someone's help on this.
