[Neos] Problems with PHP BINDIR

it seems that file_exists($phpBinaryPathAndFilename) fails on the server.
Packages/Application/TYPO3.Setup/Classes/TYPO3/Setup/Core/RequestHandler.php:149 
maybe he is locked to his home directory?
is this if statement realy needed? the stuff inside the if isnt enough?
