[TYPO3-50-general] PHP Fatal error with lampp on ubuntu

I think it might be a bug in PHP 5.3, but unfortunately I can't debug it 
further...
Removing the line "declare(ENCODING = 'utf-8');" works, bu I'm sure that 
was not intended.
