[TYPO3-commerce] Problem with parent category

I have a similar problem with latest version from trunk r51325 and TYPO3 
4.5.5. A non-admin user can't delete the topcategorie (Oberkategorie) 
from a category. When the user saved the topcategorie is always there.

Any ideas?
