Hi Again,

Maybe I should stop answering my own questions.

But found this in \TYPO3\CMS\Backend\Tree\PageTree\DataProvider at line 426:

$excludedDoktypes =
$GLOBALS['BE_USER']->getTSConfigVal('options.pageTree.excludeDoktypes');

So exclude is applied before query.
