[TYPO3-english] typo3 4.6 and GMENU layers and tt news

is anyone else having a gmenu_layer problem on 4.6?
I recently upgraded typo3 to 4.6.8 and the menu breaks on pages that 
have tt_news pluggin on it when the page is visited second time. Meaning 
when the page comes from cache.
If you clear the typo3 cache then it works the first time but if you 
refresh the page then the menu moves to the top left and doesn't closes. 
Anyone else found a solution to this problem?
