[TYPO3-english] Changes to doktype showing 'not in menu' items in custom menu extension

Dear all,

I have a custom written extension that creates a pulldown menu which 
takes all doktypes '2' from the database. Since upgrading to 4.1, and 
changing the doktype retrieved from 2 to 1, all the 'not in menu' 
flagged items are now visible.

Could someone confirm that since the change that the 'not in menu' items 
are now only hidden if you use a TS menu instead of retrieving from the 
database? Is there any way to restrict the items shown to only those 
flagged to be shown in the php code?
