No! There is perhaps some weird things with HTML but when dealing with 
XML documents (XHTML is XML) then the "&" is *always* introducing an 
entity and as such cannot be left empty and *must* be written &

Test it yourself on http://validator.w3.org/check if you do not believe 
this.
