1. If there's no code from TYPO3 it's not a fork. If you really would 
create a TYPO3 fork you could only publish it as open source software.

2. Design is also protected as it is the intellectual property of TYPO3 
community members.

3. All icons used in the TYPO3 Backend and in the TYPO3 Extensions are 
Opensource aswell unless it's stated explicitly to be not so.

If you want to create a CMS, do so. It will be a huge task. I wish you 
the best, but please leave TYPO3 alone.
