[TYPO3] Page not Found - errore 301 instead 404

Hi all!
I configure my site to redirect to a page when someone call a not found
page.
I look that typo3 answer with a 301 code, not 404.
I find a old bug (http://bugs.typo3.org/view.php?id=3532) about this of two
years ago.

With the version 4.1.5 of typo3 I need use the same patch? Or I wrong
something?
What can I check?
