[TYPO3] jm_gallery and valid XHTML

Hi
Why jm_gallery produce not valid xhtml code.
Gallery_template.html has XHTML 1.0 Transitional//EN doctype but found & 
insted of &amp;.
Even if I replace & with &amp;,  php code plugin outputs some non valid 
elements.
http://validator.w3.org founds lot of errors in "Random and single view"
