[Typo3] sys_language_mode = content_fallback

Hi,

I'm building a multi language site with the language function.
As a test I made translatio of header and content on some of my pages. 
An when viewing them (with L=1) the menu shows the translated items. But 
when having one of the nontranslated pages as the active, the menu 
reverts back to the default setting even though I still have L=1. I've 
tried sys_language_mode = content_fallback in every way I could imagine, 
but still nothing. Any experiences in this area?
To make it clearer: I want the menu to show all translated items as long 
as L=1, regardless of the page I'm on.
Is this even supported in v3.6 or only from v3.7 and on?
