the idea was that IF the TER is down you have at least what was available
back when you last updated. And if TER is down, this would be the most
updated versions anyway.

No.
Mission critical is what is paid (to say it the hard way).
Of course it is annoying if TER is down, but like jhh said: As soon as
someone comes up with a affordable and STABLE way of syncing the DB and the
filesystem across servers (don't forget traffic, NF is currently paying
that), this might be a solution.
