Yes, but he could, of course, also agree to release his js menu with 
another, GPL-compatible license, like LGPL or BSD. Your whole extension 
would still be GPL (not because of his js but because it is 
TYPO3-derived, see Karsten's posting[1]).

[1] Concerning the quoted text in his posting, I do see TYPO3 extensions 
as extensions (that's probably why we call them extensions!) and not 
plugins (although we call fe-plugins plugins).
