The "&" sign cannot exist in an XHTML valid document at any place unless
1) it is inside a CDATA tag or 2) it is initializing an HTML entity
(like © or &).

If firefox chokes on this (valid XHTML), then down/upgrade firefox.
I run Firefox 0.8 on linux without any problems. Could this be a bug in
firefox 0.9.x?
