i found another flag in php.ini wich could help with problems under safe mode.
set safe_mode_gid = On

this flag means, that not the uid is used to check permissions.
it will be checked now by the group.

make sure that your phpscripts runnig in the same group like apache.
means wwwrun or nogroup.
